The Status of Bishop Alexander John Malik? Submitted by Church of Pakistan News Service.

In the light of the facts and circumstances mentioned herein under it is a question to all the legal Bishops, members of the Church of Pakistan and Church of Pakistan Mission Partners Forum (CPMPF) including the Honorable Archbishop to clarify that whether Bishop Alexander John Malik is still a Bishop of Lahore Diocese, Chairman of the Lahore Diocesan Trust Association Limited, Moderator of the Church of Pakistan and Primate of the Anglican Communion?

Bishop Alexander John Malik elected and took oath as the eighth `Bishop of Lahore Diocese, Church of Pakistan` on 12.10.1980 under the Constitution of the Church of Pakistan and the rules and regulation framed there-under for the elections and appointments of the Bishops in the Church of Pakistan.

He continued to be associated with the Church of Pakistan as the Bishop of Lahore Diocese till 08.09.1996, when he separated from the Church of Pakistan and through some eight persons who were either related to him or were his dependents/workers including himself subscribed to a `Constitution and Bye Laws` for the purpose of setting up an independent and autonomous Church/Body under the name and style of "The Church of Pakistan Lahore Diocesan Council", registered under the Societies Registration Act 1860 vide a Certificate of Registration bearing no. RP.5734.L.S.96 in the office of Registrar Joint Stock Companies Lahore.

The ulterior purpose of his alienation from the Church of Pakistan was usurping the Church properties worth billions of rupees . It is for this reason that the fabricated `Constitution and Bye Laws` were named and styled in a manner to match the Corporate Body which were actually named and contemplated in the Memorandum and Articles of "Lahore Diocesan Trust Association Limited". The hidden intention in utilizing the format available under the Societies Registration Act, 1860 was to give a color of legitimacy to a Body which had an identical name with a body which formed the Electoral College for the formation of Lahore Diocesan Trust Association Limited, which is a company limited by Guarantee and properly registered as such vide Certificate of Registration dated 20.12.1942, which is one of the properties holding Body of the Church of Pakistan and administered Church Properties all over Pakistan worth billion of rupees.

By doing so the Bishop Alexander John Malik had ceased to be a member of the Church of Pakistan and also ceased to be a Bishop of the Church of Pakistan on his alienation from the Church of Pakistan on 08.09.1996 i.e. the date of the registration of the interpolated/fabricated Constitution and declaring free from the discipline of the Church of Pakistan.

It would be seen in Section I - Article 10 of the Constitution & Bye Laws of the `Church of Pakistan Lahore Diocesan Council` that the Church/Body setup by Bishop Malik is an autonomous Church and free from any control, legal or legislative or administrative or otherwise of any Church or Council or Synod or Society external to itself while the Section II - Article 3 prescribes that the Executive Committee of the `Church of Pakistan Lahore Diocesan Council` shall determine rules and procedure as to the election, consecration and enthronement of its Bishop from time to time, contrary to that of the Church of Pakistan. Thus, the supremacy of the Constitution of the Church of Pakistan is denied in order to monopolize the properties, assets and resources of the Church by capitalizing and monopolizing the exercise of powers into the hands of persons who are either related to Bishop or his dependents/workers.

It is rather interesting to note that the Church of Pakistan is itself an autonomous Church and according to its Constitution (Chapter X - 3) every Diocese is its territorial unit and no Diocesan Constitution or any alteration therein can be made in variance with anything contained in the Constitution of the Church of Pakistan or inconsistent therewith or repugnant thereto. The organ of the whole Church of Pakistan, comprising all the dioceses is called `Synod` and according to Chapter XI - 9 (b) the `Synod` shall have power to determine whether anything in the Constitution of any Diocese is at variance with the Constitution of the Church of Pakistan and if finds such variance, to rule that such part of the Diocesan Constitution is of no force. The `Synod` of the Church of Pakistan is the supreme supervisory and legislative body of the Church of Pakistan and the Moderator of the Church of Pakistan is the presiding officer of the `Synod`, who according to the Chapter XI - 8 (b) of the Constitution of the Church of Pakistan shall be elected from among the Diocesan Bishops of the Church of Pakistan while the arrangements for the elections and consecrations of the Bishops of the Church of Pakistan shall be under the directions of the `Synod`.

As a result Bishop Alexander John Malik is no longer a member or a Bishop of the Church of Pakistan.

It is pertinent mention that Bishop Alexander John Malik separated from the Church of Pakistan and framed the above mentioned Constitution and Bye Laws to establish an independent Church under his own authority and monopoly, in utter contradiction to the Constitution and structure of the Church of Pakistan and after alienating from the Church of Pakistan he is still portraying himself as a Bishop and the Primate/Moderator of the Church of Pakistan and making appointments of Bishops and Commissary Bishops of his own choice and convenience unlawfully and unconstitutionally with ulterior motives of usurping properties of the Church of Pakistan.

Would the Church at large take the issue in its own hand to decide prayerfully or it also has to go to the Courts of law for adjudication?
