Oslo: November 16, 2014. (Ahmar Mustikhan) Former government minister in Balochistan, who now lives in self-exile in Oslo, Norway, has drawn the attention of the United Nations secretary general to the plight of the Baloch people.
Ali Kachkol Advocate, a former fisheries minister and leader of the opposition in Balochistan, Sunday invited the attention of civilized and democratic countries to the brutalities being perpetrated on his Baloch nation.
Nearly three months ago Ali Kachkol’s son Nabeel Ahmed, 21, was forcibly abducted by the Pakistani intelligence agencies in Karachi and his whereabouts are still unknown. Pakistan’s security forces have also forcefully and illegally occupied his two homes in Turbat, hometown of Balochistan’s highly unpopular chief minister Abdul Malik. Kachkol Advocate and Malik were comrades for many decades and the chief minister was attacked by his own party men last week in Quetta, commercial capital of Balochistan, for failure to provide justice to Kachkol Advocate.
“We understand that on this planet, in this age of globalization and information technology, we are human beings without human rights. Otherwise the International community would have had taken serious action against Pakistan, due to her state terrorism in Balochistan,” Kachkol Advocate said in a letter to the United Nations.
He said it would be relevant to refer the words of the U.N. secretary-general Ban Ki-moon, when he delivered a speech at the U.N. Human Rights Council in Switzerland on August 30, 2012. He stated, “We must ensure that anyone, on any side, who commits war crimes, crimes against humanity or other violations of international human rights or humanitarian law is brought to justice. This is a shared responsibility for this council, for United Nations member states, for the international community as a whole. We must use our all many tool to shine the light on human rights everywhere.”
Regrettably, Ali Kachkol said Pakistan is committing war crimes, crimes against humanity and genocide in Balochistan with impunity. “In this respect, there are several reports from Amnesty International and Human Rights Watch as well as the apex court of Pakistan that verify the serious and flagrant consistent pattern of gross and attested violations of all human rights and fundamental freedoms of Baloch people,” he said.
“These unimaginable atrocities deeply shock the conscience of humanity,” he added.
He asked why Mr. Ban Ki-moon failed to uphold his commitment with regards to the systemic extermination of the Baloch people. “Why is the shining of light on human rights and rule of consistency missing with respect to fundamental human rights of the Baloch people? That is a big question to Ban Ki-moon and the world community.
“To my mind, it is a perverse discrimination,” he emphasized.
Ali Kachkol said as far as enforced disappearance of Baloch political workers and innocent citizens are concerned, the scenario has reached an alarming and conscience shocking level. In this connection, on the International Day of the Victims of Enforced Disappearances which was observed on August 30th 2013, the International Commission of Jurists, Human Rights Watch and particularly Ali Dayan Hassan, Pakistan director at Human Rights Watch, urged the Pakistan government to affirm it`s commitment for ending enforced disappearances by ratifying the international convention.
Ironically on August 30, 2014, Pakistan instead of ratifying the international convention for the protection of all person from enforced disappearance, shamefully ordered its security forces to forcefully abduct and disappear my son Nabeel Ahmed from Lyari, Karachi. Despite repeated denial by Pakistan security agencies, the Supreme Court of Pakistan has acknowledged and human rights groups have documented evidence of involvement of Pakistani intelligence and security agencies in enforced disappearances in Balochistan.
He said it would be pertinent to mention here that his daughter filed a constitutional petition before the honorable High Court of Sindh for recovery of her brother. On October 16, 2014, the Deputy Inspecter General Police (DIGP) undertakes before the court that if the petitioner namely my daughter, Mahparah Baloch, may lodge an FIR in respect of abduction and disappearance of my son, the same will be duly registered.
“When on October 22, 2014, my daughter went to the Police Station in Kalakot in Karachi to lodge an FIR against Commanders of ISI, IB,and MI in collaboration with law enforcement agency of Sindh in abduction of her brother, the police did not comply with the senior police official’s commitment and undertaking and did not register the FIR. That in itself is a mockery of law and justice,” he said.
Ali Kachkol said his son Nabeel Ahmed’s only sin is that he filed a constitutional petition against the inspector general of Frontier Corps for the recovery of his two houses in Turbat, which were forcibly and illegally occupied by the Frontier Corps. “This action by the Frontier Corps followed my speech at the U.N. Human Rights Council in Geneva, where I pointed out the unimaginable atrocities of Pakistan in Balochistan,” Kachkol Advocate said.
“The filing of the petition resulted in abduction of my son Nabeel Ahmed. Now, after his abduction my daughter Mahparah filed a petition against Commanders of the Inter Services Intelligence (I.S.I.) , Intelligence Bureau (I.B.) and Military Intelligence (M.I.), therefore, I fear for the future of my daughter as well. In addition, the behavior of Pakistan Government is also totally irresponsible and it seems helpless before the omnipotent security forces and intelligence services,” Kachkol Advocate said.

He said It would be relevant to express here that until now Pakistan`s failure to hold even a single perpetrator of enforced disappearance accountable exposes the culture of impunity in Pakistan. “Even the Inspector General of Police of Balochistan has candidly stated before Balochistan High Court that security forces especially the Frontier Corps is involved in enforced disappearance in Balochistan,” he said.
The security forces are forcibly disappearing, torturing and unlawfully killing Baloch innocent people in the name of counterterrorism.
The former minister, who was a professional lawyer in Balochistan, said Pakistan is seriously and flagrantly violating the provisions of ten core U.N. covenants, conventions and instruments which have been incorporated in the resolution adopted by the United Nation`s Commission on Human Rights in 2005, in respect of the Basic Principles and Guidance on the right to a Remedy and Reparations for victims of gross violations of international human rights law and serious violation of international humanitarian law.
“Whereas all the States that are members of United Nation, they are bound to observe in letter and spirit the U.N. covenants,” he emphasized.
Also, the rule of law requires compliance by the state with its obligations in international law as in national law, he said. “Tom Bingham in his masterpiece book "The Rule of Law" calls it “international rule of law.” But unfortunately, Pakistan neither respects international law nor the laws of the land,” Kachkol Advocate said.
Prior to this letter, Kachkol Advocate sent a letter to the United Nations High Commissioner for Human Rights in Geneva and copies were sent to the ambassadors of civilized countries on the subject, to save his children, but said there was no response.
Hence once again, Kachkol Advocate said he was sending this letter to leaders of the civilized world in the hope of a positive response. “While under the new norms of international humanitarian law and new ruling ideology, the civilized nations and countries are bound to carry out exemplary action when such unimaginable atrocities that Pakistan is carrying out in Balochistan is shed to light in order to end the impunity with which the state is slaughtering the indigenous Baloch population,” he said.
