Christian divorce act repealed by Lahore High Court on submission of Bishops

Karachi: May 23, 2016. (PCP) Dr. Nazir S Bhatti, President of Pakistan Christian Congress PCC have expressed grave concerns on repealing Christian Divorce Act by Lahore high Court and strongly condemned consents submitted by Bishop Alexander John Malik and Bishop Jamil Irfan to propose repeal of Section 10 of Christian Divorce Act which prohibited divorce among Christian couples according to Biblical teachings. The Lahore High Court in a judgment declared by Justice Syed Masoor Ali Shah restored Section 7 of Christian Divorce Act of 1869 and repealed Section 10 of Christian Divorce Act of 1981. Section 7 of 1869 of Christian Divorce Act permits any Christian couple to seek courts help to declare marriage null and void according to procedures adopted by British Christian society and laws; which mean any Christian couple can file for divorce negating Biblical teachings. Section 10 was introduced in 1981 in Christian Divorce Act omitting Section 7 on plea that Holy Bible teaches that Christian couples can only depart ways when any party commits “Adultery”. The Judgement resulted on a petition of one Christian from Lahore in LHC to divorce his wife while Christian woman was not ready to accept divorce and she was not falling in any sort of “Adultery” by applicant and Section 10 not permitted it. The Lahore High Court invited Bishop Alexander John Malik and Bishop Jamil Iran, both leaders of Church of Pakistan, to submit religious decree on Section 10 of Christian Divorce Act, who very surprisingly turned away from Biblical stand on Christian divorce and marriage and supported court to repeal it and supported British procedural system on Christian Divorce. PCC Chief said “Introduction of Section 7 in Christian Divorce Act will damage Christian life and identity in Islamic Republic of Pakistan and Bishop Alexander John Malik and Bishop Jamil Irfan will stand responsible for it on misleading Lahore High Court” Nazir Bhatti said “I am surprised by repealing of Christian Divorce Act by Single Bench Court of Lahore High Court when Lahore High Court Double Bench headed by Chief Justice of LHC on my petition to repeal Blasphemy Laws in 1998, issued judgment that courts can only interpret law but cannot repeal any law because legislators have constitutional forums to repeal or amend any law which clearly indicates that Single Bench of LHC have crossed lines in Christian Divorce Act” The repeal in Christian Divorce Act by LHC will increase enforced conversion of Christian women to Islam in Pakistan and marriages to Muslim.
