Leader of Commonwealth UK should persuade Canada to take the controversy between two commonwealth countries to legitimate legal conclusion. By Hem Raj Jain
If agents of the Government of India were involved in murder on Canadian soil of Canadian citizen then why were these Indians allowed to leave Canada ? (ii)_ THe trend of accused not produced before court should stop (iii)- UK should persuade Canada to take its controversy with another commonwealth country India to legitimate legal conclusion
The expulsion of Diplomats by Canada and India (as reported at https://www.msn.com/en-us/news/world/india-expels-canadian-diplomat-in-tit-for-tat-move-as-spat-over-assassinated-sikh-activist-deepens/ar-AA1gUcjh and https://www.youtube.com/watch?v=yaS0IxFGbNY ) is unfortunate to say the least.
If what was accused by Canada about involvement of an Indian (allegedly used by Indian High Commission in Canada) in the murder of a Sikh activist NIjjar is true then Canada should prosecute in the courts of Canada these Indians who are allegedly complicit in the said murder
IF this accused Indians are not in Canada but have gone to India then government of Canada should ask government of India to hand them over to Canada for producing them before Canada court and if govt of India doesn't do so then govt of Canada should approach "international Court of JUstice / Interpol to get these accused in Canada court from India.
IF Canada doesn't take this matter to the said legal conclusion by prosecuting the said accused INdian in the court of Canada then it will be legitimately construed that Canada is behaving irresponsibly in such an extremely important international matter between two commonwealth countries.
Moreover it is intriguing that why the government of Canada in the first place allowed these alleged accused Indians to leave Canada ?
AT the same time Canada should not follow the policy which the USA did about 9/11 where Osmama bin Laden was not produced before court in New York to face the charges (though Laden as per Amnesty international (AI) & BBC https://www.bbc.co.uk/news/world-south-asia-13257330 could be arrested alive because as per them Laden was unarmed ). Instead Canada (if a responsible country) should ensure that the said accused Indians face charges in the court of competent jurisdiction in Canada so that such matters of international importance can be decided in a transparent and legally permissible / expected manner.
Also Commonwealth has remained a defunct and merely a decoration piece during the leadership of Queen Elizabeth- II (mainly due to simultaneous launch of the UN) but with change in its leadership and with destruction of the UN due to Ukraine war it is hoped the leader of Commonwealth the UK will persuade Canada to take its controversy with another commonwealth country India to legitimate legal conclusion in an extremely important matter which impacts the sovereignty of both the countries.
