USA has 21 days to constrain its President and Congress to amend & improve immigration laws. By Hem Raj Jain


President Donald Trump on Friday January, 25 announced through a speech that a tentative deal has been reached to temporarily end the shutdown and reopen the government after 35 days, the longest in U.S. history. In this speech Trump rightly pin-pointed the main problem namely inadequate US Laws to tackle the problem of millions of illegal immigrants (as per Trump ~ 11 million and generally believed to be ~ 22 million) which has cased myriad problems in USA including body related crimes, sex related crimes, drug trafficking, social problems, financial burden on State, snatching of jobs of US citizens by illegal immigrants, very big health crisis for illegal immigrants etc.

Though the main problem of inadequate US laws was high-lighted in this speech by Trump by saying that –“[The sheer volume of illegal immigration has overwhelmed federal authorities and stretched our immigration system beyond the breaking point. Our backlog in the immigration courts is now far greater than the 800,000 cases that you've been hearing about over the last couple of years. Think of that, though, 800,000 cases because our laws are obsolete, so obsolete. They're the laughing stock all over the world. Our immigration laws all over the world--they've been there for a long time--are the laughing stock all over the world]” and “[Our laws are so obsolete, so antiquated, and so bad]”.

But Trump has not mentioned anything about as to how he will get these laws amended and improved in coordination with Congress (both the Senate and House). On the contrary Trump through this speech also threatened about getting funds for wall by declaring national emergency after 21 days by saying that “[So let me be very clear, we really have no choice but to build a powerful wall or steel barrier. If we don't get a fair deal from Congress, the government will either shut down on February, 15 again or I will use the powers afforded to me under the laws in the Constitution of the United States to address this emergency]”.

The confusion of Trump in this matter originates due to and from the example of Israel when he said that – “[They (wall) do work. No matter where you go, they work. Israel built a wall, 99.9 percent successful. Won't be any different for us]”. Trump forgot that Israel is facing all these problems because USA is supporting absurd Two-State-solution for Israel-Palestine (one for Jews and other for Muslims and which has alienated both the communities) instead of desirable One-State-solution (one secular State for both Jews and Muslims). This illogical & unethical Two-State-solution has rendered Israel to such a pathetic situation that it is facing existential problem and can’t even survive without support of West led by USA. This is the reason Israel may need a wall but not the USA which does not have such existential problem.

Moreover Trump forgot that USA is the leader of free world responsible for global order hence whatever USA does will be a precedent for other countries to emulate. Trump himself said in this speech that “[It's at the worst level, human trafficking, in the history of the world. This is not a United States problem. This is a world problem]”. But Trump owes an explanation to rest of the world that - whether by suggesting border wall for USA is Trump suggesting for rest the world that they should also build border wall to tackle the problem of illegal immigrants?

The right course for Trump is to work with Congress to amend and improve US laws / Constitution in order to identify millions of illegal immigrants in USA, keep a track of them and then ask them to go to their countries [USA should ask under military pressure the countries of these illegal immigrants to accept them and if they refuse then USA should claim commensurate territory or exclusive mineral rights from these offending countries and then can grant citizenship to these illegal immigrants after imposing reasonable fine on them]. This will protect the human rights of also the illegal immigrants (as per human rights related laws of UN which expects every human being to be a citizen of some UN member country). But said amended and improved US laws / Constitution alone will not solve the problem of illegal immigrants in USA and in many countries of the world. For the complete solution of this problem the USA will have to launch ‘International Political Parties’ (IPPs) too, registered at UN.

The IPPs are needed because the people of many countries in Asia, Africa, South & Central Americas etc are not competent to manage their political affairs which has not only created many problems to the people of these countries but has also created problem of illegal immigrants for other countries in USA, Europe etc. In addition to IPPs USA should also work for replacing Optional-protocol OP-1 of ICCPR with Mandatory-protocol MP-1 in such a way that even citizens of member countries can move UN to protect their human rights (even with military intervention) in case UN member countries violate human rights of its citizens (including member of IPPs) brazenly and flagrantly. In case veto wielding permanent members of UN put hurdles in the path of introducing IPPs and MP-1 at UN then USA should launch a mini-UN to realize these objectives.

President Trump and members of Congress (both Senate and House) do not seem to be prepared to amend and improve US laws / Constitution to tackle the problem of illegal immigrants, properly& completely, in above mentioned way. Therefore the people of USA are under trial for 21 days to prove that they can constrain them to bring about said amendment and improvement in US Laws / Constitution.
